The rules that govern your use of www.thirupathicanda.org.

These Terms of Service (the “Terms”) form a binding agreement between you and the operator of www.thirupathicanda.org (the “site”). Please read them carefully. By using the site you agree to be bound by these Terms.

Acceptance of these Terms

By accessing or using www.thirupathicanda.org you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the site.

About the site

The site is a free, non-commercial devotional resource that publishes prayers, festival information, scripture excerpts, translations, and reflections on the worship and teachings of Lord Sri Venkateswara, the Lord of the Seven Hills.

The site is operated by an independent volunteer in Canada and is not affiliated with, endorsed by, or representing the Tirumala Tirupati Devasthanams (TTD) or any government, temple, or religious authority.

Eligibility

You may use the site if you can form a binding contract under the laws of your jurisdiction. The site is not directed at children under thirteen years of age, and persons under thirteen should not submit any personal information through the site.

Acceptable use

You agree to use the site lawfully and respectfully. In particular, you agree not to:

  • Submit information that is false, misleading, abusive, threatening, defamatory, hateful, or otherwise unlawful under Canadian law.
  • Attempt to gain unauthorized access to the site, the administrator backend, the database, or any underlying infrastructure.
  • Probe, scan, test, or interfere with the integrity or security of the site or its anti-spam systems.
  • Use the site to transmit spam, malware, or any automated commercial message in violation of CASL.
  • Scrape, copy, or republish the site’s content in bulk without prior written permission, except as expressly permitted under “Intellectual property” below.

Information you submit

When you submit information through the contact form or subscribe to the newsletter, you confirm that the information is accurate, that you have the right to submit it, and that you grant the operator the right to use it solely for the purposes described in our Privacy Policy.

We may decline to respond to messages that are abusive, off-topic, or that we reasonably believe to be automated.

Intellectual property

All original text, design, code, photographs, and translations published on the site are © the operator unless otherwise marked, and are made available for personal, non-commercial devotional use.

Sanskrit, Tamil, and Telugu scripture excerpts published on the site are part of a longstanding religious tradition and are reproduced for educational and devotional purposes; where a particular translation is sourced from a third party, attribution is provided alongside the excerpt.

You may share short excerpts of the site’s content with proper attribution and a link back to the original page. You may not reproduce, distribute, modify, or create derivative works of any substantial part of the site for commercial purposes without prior written permission.

Translations

The site is offered in English, Tamil, and Telugu. We make every reasonable effort to ensure translations are accurate, but they are provided in good faith and may contain inaccuracies, omissions, or interpretive choices that differ from other published translations. The original Sanskrit verses, where applicable, are the canonical source of meaning.

Religious and educational disclaimer

The content on the site is published for general informational, educational, and devotional purposes. It is not professional advice — religious, medical, legal, financial, or otherwise. Practices described on the site should be undertaken at your own discretion and, where appropriate, under the guidance of a qualified teacher or priest.

Third-party services and links

The site is hosted and powered by third-party service providers (see our Privacy Policy for the list). Their availability and behaviour are outside our control, and outages or changes by those providers may affect the site.

The site may link to external websites for reference. We are not responsible for the content, privacy practices, or availability of those external websites.

Disclaimer of warranties

The site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we make no warranties — express, implied, statutory, or otherwise — about the site, including any warranty of accuracy, fitness for a particular purpose, non-infringement, or uninterrupted operation.

Nothing in these Terms limits or excludes any consumer-protection or other right that cannot lawfully be limited or excluded under applicable Canadian law.

Limitation of liability

To the maximum extent permitted by applicable law, the operator will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, or expected savings, arising out of or in connection with your use of (or inability to use) the site.

Where liability cannot be excluded as a matter of law, the operator’s aggregate liability to you in connection with the site is limited to the greater of (i) the total amount you paid the operator to use the site in the twelve months preceding the claim (which, for a free site, is nil), or (ii) ten Canadian dollars (CAD $10).

Indemnification

You agree to indemnify and hold harmless the operator from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms or your unlawful use of the site, except to the extent that the claim arises from the operator’s own wilful misconduct or gross negligence.

Suspension and termination

We may suspend, restrict, or terminate your access to the site, or refuse to deliver newsletter messages to you, at any time and without prior notice if we reasonably believe you have breached these Terms or used the site unlawfully.

You may stop using the site at any time. You may unsubscribe from the newsletter as described in the Privacy Policy.

Changes to these Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent change. Material changes will be communicated through a banner on the site or through the newsletter where appropriate. Continued use of the site after changes take effect constitutes your acceptance of the revised Terms.

Governing law and jurisdiction

These Terms and your use of the site are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.

Any dispute arising out of or relating to these Terms or the site shall be brought exclusively in the courts located in British Columbia, Canada, and you irrevocably submit to the jurisdiction of those courts. Nothing in this section limits any non-waivable right you may have under the consumer-protection laws of your home province.

Severability and waiver

If any provision of these Terms is held to be unenforceable, the remaining provisions remain in full force and effect, and the unenforceable provision will be modified only to the minimum extent necessary to make it enforceable. Our failure to enforce any provision of these Terms is not a waiver of that provision.
